SMS Messaging Policy

1. About this policy

StaffingAgent.ai is a middle-office automation platform operated by StaffingAgent LLC. The platform sends operational SMS messages to contract workers and internal staff on behalf of its staffing firm customers. This policy describes how consent to receive those messages is obtained, stored, and honored.

2. Who collects consent

Express written consent to receive SMS messages is collected by the staffing firm (the StaffingAgent customer) at the time of candidate onboarding. StaffingAgent LLC does not collect consent directly from candidates; it sends messages only on behalf of staffing firms that have obtained prior express written consent from the recipient.

3. How consent is collected

During candidate onboarding, the staffing firm presents the candidate with an SMS consent disclosure as part of the application or hiring process. The candidate must affirmatively agree (typically by checking a box and/or electronically signing an onboarding form) to receive operational text messages related to their employment.

Sample consent language used by staffing firms:

“By providing my mobile number, I consent to receive operational text messages from [Staffing Firm Name] and its service providers, including timecard reminders, schedule updates, and assignment-related notifications. Message frequency varies. Message and data rates may apply. Reply HELP for help, STOP to opt out at any time. Consent is not a condition of employment.”

4. Where consent is stored

Affirmative SMS consent is recorded on the candidate record within the staffing firm’s Applicant Tracking System (ATS). The StaffingAgent platform validates this consent flag before sending any SMS message. Messages are not sent to candidates without affirmative consent on record.

5. Types of messages sent

All messages are operational and event-driven. StaffingAgent.ai does not send promotional, marketing, or recruiting outreach SMS through this messaging service.

6. Message frequency

Message frequency varies and is event-driven. A typical contract worker may receive between zero and three messages in a given week, depending on whether a timecard or other operational action is required.

7. Opting out

Recipients may opt out of SMS messages at any time by replying STOP to any message received. Opt-outs are honored immediately and are recorded on the candidate’s record in the staffing firm’s ATS to prevent future sends. To re-subscribe, the recipient may reply START or contact their staffing firm representative.

9. Carrier disclosure

Message and data rates may apply. StaffingAgent.ai and its staffing firm customers are not responsible for charges imposed by the recipient’s mobile carrier. Delivery of messages is subject to carrier conditions and is not guaranteed.

10. Privacy

Personal information collected and processed in connection with SMS messaging is handled in accordance with the StaffingAgent.ai Privacy Policy. Mobile phone numbers and SMS opt-in data are not sold, rented, or shared with third parties for marketing purposes.
