SMS Messaging Policy

1. About this policy

StaffingAgent.ai is a middle-office automation platform operated by StaffingAgent LLC. The platform sends operational SMS messages to contract workers and internal staff on behalf of its staffing firm customers. This policy describes how consent to receive those messages is obtained, stored, and honored.

For contract workers and candidates, SMS consent is obtained directly through StaffingAgent’s first-message opt-in flow before any operational messages are sent. Consent for SMS messaging is required to use StaffingAgent’s candidate notification services.

2. Who collects consent

StaffingAgent LLC collects express consent to receive SMS messages directly from the recipient through the first text message sent to that phone number on behalf of the staffing firm (the StaffingAgent customer).

Staffing firms provide candidate contact information and authorize StaffingAgent to send messages on their behalf. A mobile number on file in the staffing firm’s Applicant Tracking System (ATS) does not, by itself, constitute consent to receive SMS from StaffingAgent.

Consent for candidate SMS notifications is a requirement of service. StaffingAgent will not send operational candidate messages to a phone number that has not completed the first-message opt-in flow.

Internal staff alerts to authorized recruiters and account managers at the staffing firm follow a separate authorization process managed by the customer organization.

3. How consent is collected

Before any operational SMS is sent to a contract worker or candidate, StaffingAgent sends a one-time opt-in request to that phone number. This is always the first SMS sent to that number through the platform for that staffing firm.

The opt-in message includes:

The recipient must affirmatively reply YES to grant consent. Until an affirmative opt-in reply is received, StaffingAgent sends no operational SMS to that number — including timecard reminders or other assignment notifications.

If the recipient does not reply YES, StaffingAgent sends an opt-in reminder message every 72 hours. Reminder messages repeat the same consent disclosure and YES / STOP / HELP instructions. Reminders stop when the recipient replies YES, replies STOP, or the placement ends.

Sample first-message opt-in text:

[Staffing Firm Name]: [Staffing Firm Name] uses StaffingAgent to send operational text messages about your assignment — timecard reminders, schedule updates, and related notifications. Message frequency varies. Msg & data rates may apply. Reply YES to receive messages. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of employment.

Sample opt-in reminder text (sent every 72 hours until YES or STOP):

[Staffing Firm Name]: Reminder: reply YES to receive operational text messages from [Staffing Firm Name] about your assignment (timecard reminders, schedule updates). Msg & data rates may apply. Reply STOP to opt out. Reply HELP for help.

4. Where consent is stored and tracked

When a recipient replies YES, StaffingAgent records consent in its platform audit trail, including at minimum:

Consent status is synchronized to the candidate record in the staffing firm’s ATS. StaffingAgent validates consent in its own records before every send; operational messages are not sent without a recorded affirmative opt-in.

Opt-out replies (STOP and carrier-standard variants) are honored immediately, recorded in the same audit trail, and synchronized to the ATS to prevent future sends.

5. Consent required for service

SMS-based candidate notifications are a core capability of the StaffingAgent platform. By enabling SMS outreach for a placement, the staffing firm customer acknowledges that:

StaffingAgent does not send promotional, marketing, or recruiting outreach SMS through this messaging service regardless of opt-in status.

6. Types of messages sent

All candidate-facing messages are operational and event-driven. StaffingAgent.ai does not send promotional, marketing, or recruiting outreach SMS through this messaging service.

7. Message frequency

Operational message frequency varies and is event-driven. A typical contract worker who has opted in may receive between zero and three operational messages in a given week, depending on whether a timecard or other operational action is required.

During the opt-in period (before the recipient replies YES), StaffingAgent sends an initial opt-in request followed by reminder messages every 72 hours until the recipient replies YES or STOP, or the placement ends.

8. Opting out

Recipients may opt out of SMS messages at any time by replying STOP to any message received. Opt-outs are honored immediately and are recorded in StaffingAgent’s audit trail and on the candidate’s record in the staffing firm’s ATS to prevent future sends.

If a recipient opts out before completing the initial opt-in (for example, by replying STOP to the first message or a reminder), no further messages are sent and no consent is recorded.

To re-subscribe after opting out, the recipient may reply START or contact their staffing firm representative, which may trigger a new opt-in request.

9. Help

Recipients may reply HELP to any message for assistance, or contact support@staffingagent.ai.

10. Carrier disclosure

Message and data rates may apply. StaffingAgent.ai and its staffing firm customers are not responsible for charges imposed by the recipient’s mobile carrier. Delivery of messages is subject to carrier conditions and is not guaranteed.

11. Privacy

Personal information collected and processed in connection with SMS messaging is handled in accordance with the StaffingAgent.ai Privacy Policy. Mobile phone numbers and SMS opt-in data are not sold, rented, or shared with third parties for marketing purposes.
